In the spring of 2016, the Georgetown Institute for the Study of Markets and Ethics (GISME) will host two Junior Faculty Manuscript Workshops. The first workshop will be held on April 29 in Hariri room 570.

Author: Jessica Flanigan
Manuscript title: “Liberal Medicine”
Commentators: Sarah Conly (Bowdoin College), David Sobel (Syracuse University) , Alex Tabarrok (George Mason University).

This manuscript is the first sustained philosophical analysis of pharmaceutical ethics. The central argument is that the principles that warrant respect for patients’ rights in other areas of medicine require wide-ranging reforms to pharmaceutical regulation. Specifically, the very reasons that justify the doctrine of informed consent, the right to die, the right of self-preservation, and rights to make intimate and personal decisions, also justify rights to access pharmaceuticals. In all developed countries, if a competent and informed patient decides to refuse pharmacological treatment, even if refusal is medically risky, her physician must respect her decision. If a physician or public official coerced or tricked her into making a medically advisable decision it would be a serious breech of professional ethics. Yet if a competent and informed patient wishes to access pharmaceuticals against medical advice, pharmaceutical regulators and physicians are legally empowered to stand in his way. “Liberal Medicine” makes the case that this inconsistency is unwarranted and concludes that prohibitive pharmaceutical policies are unjust.

Each workshop will consist of several sessions dedicated to discussion of the author’s manuscript. Sessions will begin with a critical commentary on a section of the manuscript by an invited participant. The author will then have the chance to respond and subsequently open up the floor for further commentary and discussion. The format is designed to maximize feedback for the author.

If you are interested in attending the workshop, please email Michael Kates at [email protected] for a detailed schedule and copy of the manuscript.
